The contract and all matters arising from the contract are subject to EU Law and the exclusive jurisdiction of the EU Courts. In the event that any of the provisions of this contract shall be determined by any Court to be invalid, unlawful or unenforceable to any extent, then such provision shall to that extent be severed from the remaining provisions of this contract, which shall continue to be valid and enforceable.

“Force Majeure” is defined as any situation beyond the control of VRTW which can be, but is not limited to, natural disaster, nuclear disaster, adverse weather or road conditions, landslides, avalanches, fires, flooding, hurricanes, tornadoes, disease, bureaucratic obstacles, political disruption, industrial disputes, civil unrest, war, threat of war, outbreak of war, terrorist activity, changes in schedules by ferry companies, airlines, local or international bus or train/rail operators, or any of their agents.

5. Acceptance of Risk

Your booking is accepted on the understanding that:

A) Participant(s) acknowledge that the fun and excitement of adventure motorbike travel carries inherent risks, such as riding through lesser-developed countries, on undeveloped roads, and undertaking activities beyond the levels of safety, which are perceived as normal, both at home or at work, and that these inherent risks contribute to the enjoyment of the Expedition.

B) Participant(s) are aware that in addition to the usual dangers and risks inherent in travel, Expedition riding has certain additional dangers and risks, some of which may include: weather extremes subject to sudden unexpected change, physical exertion for which you may not be prepared, remoteness from medical services, evacuation difficulties if you are injured or disabled, and unpaved road surfaces.

C) Participant(s) acknowledge that the nature of travelling overland on a motorcycle adventure, requires Participants who are open minded, adaptable, and who can be relied on to be team players, also with a sense of humour in challenging times. You must be flexible and allow for alternatives, some of which may include having to take a different road/route, or a change in accommodation, or not arriving at the day’s final destination, or the schedule being delayed in order to assist another member of the group, who may be experiencing difficulty.

D) Participant(s) understand that itineraries, amenities, schedules, methods of transport, or routes may be subject to alteration without prior notice, due to local circumstances or events, such as events emanating from political unrest or disputes, strikes, entry or border difficulties, mechanical breakdown, flight cancellations, sickness, climate and/or other unforeseeable circumstances.

E) Participant(s) booking an Expedition implicitly accept and acknowledge that parts of Eastern Europe and The Far East are underdeveloped in relation to roads, municipal infrastructure, and tourist infrastructure. On a particular day, the Expedition may experience delays along the route, better or worse than expected riding conditions, and arrive at the destination later or sooner than planned. It is therefore important for riders to be flexible and accommodating, as long distance journeys are, by their very nature, unpredictable, and can require modification or adjustments, along the way.

F) Participant(s) acknowledge that in some regions, attitudes to safety differ from the western world. Safety equipment may not be provided, seat belt regulations or minimum standards of driving safety may not be enforced. Participant(s) must therefore accept the ramifications and consequences of different attitudes, cultures, and ways of life, which may infringe on your own perception of safety.

G) Participant(s), along with their motorcycle, equipment, belongings, baggage, documentation, and other property, travel entirely at their own risk. Participant(s) acknowledge that participating in an Expedition means exposing yourself to certain risks, including, but not limited to, the hazards of riding your own motorcycle, the forces of nature, crime, of travelling at altitude through mountainous terrain, and the fact that some of the areas through which you will travel will have limited medical facilities. Participant(s) must therefore ensure they have relevant insurance cover for this type of Expedition.

You are solely responsible for the condition of the motorcycle, your helmet and rider equipment, and ensuring that it is safe for use. Your motorcycle must be in good, road-legal condition. In the event of a mechanical failure, all additional costs associated with the repair of the motorcycle are the responsibility of the Participant(s).

I) Participant(s) are responsible for their safety and their own motorcycle, including its use, how they ride it, and conforming to local laws, speed limits and regulations. A helmet must be worn at all times while riding, with no exceptions.

J) Participant(s) are also responsible for any pillion passengers being carried. A road traffic accident that occurs to Participant(s) causing personal injury or death will never be the responsibility of VRTW or any support guide who may accompany the group, unless we are shown to have been legally negligent. Neither VRTW, it’s employees or agents are responsible for the Participant(s) safety, and are not liable for any occurrence in connection with the Participant(s) activity on the Expedition, which may result in injury, death or other damage to the Participant(s) or their property.

K) In booking an Expedition, You are responsible for making yourself aware through your home country’s Foreign Office, State department warnings, advisers and other sources available to You, in regard to the safety of the countries and areas in which You will be travelling, as a citizen of your home country, and to make your own decisions, accordingly.

L) You must abide by all local laws and customs of the countries visited, including, but not limited to, condition of Your motorcycle, traffic regulations, Your ability to ride the motorcycle, and all other laws, motorcycle clothing and equipment. In the event that You are stopped or detained by the local authorities, the consequence of this remains Your responsibility. If You commit an illegal act We shall cease to have any responsibility to you, or for You.

M) By signing the booking form, Participant(s) agree to accept the authority and decisions of any support guide accompanying the group during the Expedition. If, in the opinion of any support guide, your health, actions, or conduct appears to endanger the safety or wellbeing of the group, or the progress of the Expedition, You may be excluded from the whole, or part, of the Expedition.

N) We will not be able to provide assistance to You to the detriment of the other Participants of the Expedition. You may rejoin the Expedition at any time, provided You are fit to do so. Should a Participant leave an Expedition prior to the end, for whatever reason, no refund will be made.

O) Your pre- and post-expedition flights. It is Your own responsibility to purchase Your own flights to and from the Start and Finish of the Expedition. We recommend that you wait with purchasing your flights until you have paid the Deposit, and your Visa paperwork is underway, or approved.

7. VRTW Responsibilities

A) VRTW are responsible for ensuring that the Expedition services booked will be organised as described in booking documents provided to You. We will use our reasonable skill and care. If you wish to make a claim against us, you must show that reasonable skill and care has not been used.

In all instances, VRTW liability will be limited to the amount paid by The Participant to VRTW. In countries where the standards of safety, road use, driving, hygiene, health, and quality of overnight accommodation can be significantly lower than in your own country, reasonable skill and care is to be determined by what is normal for local standards and customs, and in accordance with any applicable local regulations.

B) The itineraries and other details set out on the VRTW website, and in any documents supplied to you, are provided in good faith. Any advice that We provide to You on matters such as permits, visas, vaccinations, climate, clothing, baggage, special equipment, etc. is given in good faith but without any responsibility on the part of VRTW.

The running times are estimates only, and We will not be liable for any loss (howsoever caused) arising from the delay, or failure to operate services, in accordance with estimated timings. If any additional expenses are incurred by the Participant(s) through delays, accidents or disruption in planned itineraries, because of Force Majeure, or are considered advisable by Us or any support guide, then these are borne by the Participant(s). The Participant(s) accept that Force Majeure may prevent VRTW or recommended agents from supplying the Expedition as described.

We will make every effort to ensure that proper arrangements have been made for all Expeditions, and that the suppliers of the services which You will enjoy during your Expedition, are efficient and reputable. We cannot be responsible for some services not working due to maintenance requirements or adverse weather conditions, or for hotel services which are cancelled, due to low client numbers in the hotel.

C) We accept responsibility for any deficiencies in the services We are contractually obliged to provide. We shall not be responsible for any incidents, injury or illness caused by activities engaged in, which are outside the scope of the Expedition itinerary. You, your family members, legal representatives, heirs, successors and assigns agree to release VRTW, its owners, officers, employees, suppliers, contractors and affiliates, from any and all legal claims, debts, actions and liability which may arise, directly or indirectly, from your participation in any or all aspects of the expeditions offered.

D) Our liability is limited to any damage caused to the Participant(s) by Our failure to perform the contract, or the improper performance of the contract, unless the failure or improper performance is due neither to Our fault nor the fault of another supplier of services, because it is the fault of the Participant(s), or a third party unconnected with the provision of the services contracted for, or was due to unusual or unforeseeable circumstances, which could not have been avoided, even if all due care had been exercised.

E) Where VRTW is found to be liable for damages in respect of its failure to carry out the contract, the maximum amount of such damages will be limited to the price paid for our services.

In the rare circumstances where We need to make a significant change We will notify You as soon as reasonably possible prior to departure.

“Significant” changes for the European tours & Expeditions are considered to be not visiting one or more of the main cities or highlights listed in the itinerary, and all other changes are defined as minor changes. “Significant” changes for the China and North American Expeditions are considered to be not visiting one or more of the countries listed in the itinerary, and all other changes are defined as minor changes. In the event of a significant change, You have the following options:

Once the expedition is underway, if failure to progress and fulfill the expedition is as a result of Our or our agents failure to provide certain contracted services, we will refund up to 50% of the expedition fees paid to VRTW.

If the failure to be granted travel is as a result of Force Majeure we may offer certain alternative travel arrangements, up to a maximum of 50% of the VRTW fees, at our discretion.

Participants should be aware that a travel Visa does not guarantee them entry into any Country and that border immigration always reserve the right to decline entry. In such exceptional circumstances, whilst we accept no liability for any Force Majeure, we would endeavour to offer assistance to enable the participant to complete an alternative route.

11. Alcohol and Narcotic substances

VRTW has a strict zero-tolerance for narcotics and narcotic-related incidents, while you are participating on a VRTW Expedition. Being under the influence of narcotics puts both you and the group under an unacceptable and unnecessary risk, both physically, mentally and legally.

Neither the group, The Company, nor it’s partners will accept responsibility for your contravention of local laws, in any country. This is enforced to protect the other members of the group from prosecution, as well as the guides, the team, The Company, it’s agents, it’s reputation, and it’s local partners.

Consumption of illegal narcotics in any form, will immediately render your participation in the expedition null and void, with no possibility for a refund. Repatriation of yourself and your vehicle will become your own responsibility, as will any legal entanglements and proceedings You incur with local authorities.

Alcohol - If you want to enjoy one or two beers or glasses of wine in moderation in the evenings after a great day’s riding, that is entirely at your own discretion. However, if you consume too much alcohol on the night before a riding day, and have to take some extra hours at the hotel in the morning to recover, then it is your own responsibility to catch up with the rest of the group, the following day.

VRTW encourages drinking responsibly when You are not riding, and will take steps to ensure that you do not have alcohol or narcotics in your system on riding days. When participating in one of our expeditions, You accept that tour leaders have the right to demand that You agree to a breathalyser and/or drug test before riding. If You test positive, tour leaders have the right to exclude you from driving with the tour group to ensure Your own safety, and the safety of others. In such case, arrangements will be made in relation to a location that you can rejoin the group at a later date.

Furthermore, we don’t tolerate drinking alcohol at lunchtime on riding days, or AT ANY TIME when you will be riding motorcycles in or with the group, or otherwise. All other off-bike and after-bike times and rest days are fine, once your actions don’t endanger the other members of the group, or it’s staff or partners.

12. Transfer of Booking

If the Participant(s) are prevented from travelling for any reason, the expedition services are non-transferable. We advice that you take out comprehensive travel insurance to cover travel and financial risks, from the time you make your expedition booking.

13. Expedition Motorcycle Maintenance & Assistance

In the event of any incident, or difficulties with your motorcycle, Guides can assist to move motorcycle and rider to the closest suitable safe location, from where you can assess and take appropriate action. Any further procedures and local services, repatriation of motorcycle or rider, are at Your own expense.

All participants should be able to perform all basic day-to-day motorcycle checks and maintenance themselves, and locate a suitable service stop, for routine brake, oils and filter change. (These items can be carried in the support vehicle at our discretion).

Within China, the Chinese support vehicle may be used at the Chinese expedition leaders discretion, to provide emergency assistance and onward travel to the nearest Suitable Destination, from where you can arrange further assistance.

All costs incurred to third parties (e.g. local mechanics, spare/replacement parts, or shipping agents, as well as repatriation of motorcycles) are payable by individual participants.

Please note, that due to certain schedule restraints for entering and traveling within China, if any participant experiences an incident resulting in significant delay, it may in certain circumstances be necessary for you to make your own onward or return travel arrangements. We will, of course, assist riders with any onward travel arrangements, wherever possible.

Participants should be aware that these types of expeditions do carry certain risks, which could lead to circumstances where you would need to arrange your own repatriation, for yourself and your motorcycle.

We suggest that you factor for this, and make an allowance in your reserve travel budgets, should the need arise. We suggest you have an emergency contingency budget of at least €5,000 in available funds.

14. Personal Data Protection

Your Data protection while on the road

It is each rider’s own responsibility to maintain and update their Antivirus software on their own laptop and devices, and to protect their own connections, when logging onto unknown or untrusted public Wifi networks, such as at hotels, airports, restaurants, bars, etc. VRTW recommend using F-Secure Freedome VPN (Virtual Private Network) to protect your online connections, when using untrusted public networks.
